International Law Argument Against UNSC 2334 and Barack Hussein Obama's Rendition

Reminder:  Jerusalem has been the capital of Israel and of Judah  from King David's realm of 1010 BCE until 70 CE when Romans burned it all down.  

The title of a book that tells all about how Obama's goal was to get Jerusalem's Western Wall out of the hands of the Israelis was written in 2017. That is pretty shocking to most American Jews. 

The Western Wall is the only place that allows Jews to pray there on the Temple Mount.  There are Muslim prayer policemen from Jordan that watch lips of people who dock a person if caught praying.  That's because Israel's Moshe Dayan to make a deal with Jordan's leader to be in charge of the religious factor with all the mosques on the Temple Mount. 

 It was a good idea at the time, but they have taken advantage of their position immensely to the point of being ridiculous.  To keep this peace, Israel has allowed it since some rabbis are against praying up there anyway.  Our 2nd Temple is supposed to be under the Al Aqsa Mosque and that includes the Holy of Holies area where Jews were not to be in. Their advice is to pray at the Wall.

Obama's assault on Jerusalem's Western Wall: --"Bill Clinton's Parameters (2000): The Temple Mount in Palestine, the Western Wall in Israel." --"Obama's UNSC 2334 : both are in Palestine" Paperback – June 30, 2017

This book reveals Obama's role in the plot to take the Western Wall from Israel-
The newer villages, towns and cities occupied only 1.7% of Judea-Samaria "the West Bank back in 2017-5 years ago." The Obama administration lied about "massive settlement construction". By inventing the fake news of “massive settlement construction”, they created a false sense of urgency to justify the anti-Israel UNSC 2334 resolution. -

Obama's UNSC 2334 ruled that “the establishment by Israel of settlements in the Palestinian territory occupied since 1967, including East Jerusalem, has no legal validity and constitutes a flagrant violation under international law,” saying that The UNSC 2334 rules that both the Temple Mount and the Western Wall are in “occupied Palestinian territory”-

This is the complete opposite of what Professor Kontorovitch has said who is an international lawyer. 
 
  1. Israel's settlements (word for villages, towns and cities) do not violate international law.

While issues of international law are both complex and fuzzy, suffice it to say that according to international legal expert Eugene Kontorovich, the UNSC cannot make international law. Indeed, Resolution 2334 instead cites as its legal authority the Fourth Geneva Convention.

Simply stated, this convention holds that a country cannot forcibly move its population into another state's conquered territory. Read these words carefully. Since Israel has not forcibly moved any people into Judea-Samaria – all have settled there on their own initiative – Israel does not violate this stricture.

In addition, prior to Israel taking control of Judea and Samaria in 1967, this previously stateless territory was occupied illegally by Jordan, which conquered it temporarily during the 1948 War of Independence. Jordan has since entered into a peace treaty with Israel and given up its claim to all lands in Judea and Samaria, and thus Israel's settlements are in no way occupying the land of another state.   

                                                                                         

In his autobiography Bill Clinton describes his parameters for a final status agreement (2000): Clinton was president from 1993 to 2001.  
“On territory, I recommended 94 to 96 percent of the West Bank for the Palestinians with a land swap from Israel of 1 to 3 %, and an understanding that the land kept by Israel would include 80 percent of the settlers in blocs...

The Al-Aqsa Mosque is the name of the mosque that sits atop the Temple Mount in Jerusalem. In a narrow view, it refers to just the mosque, but it can also refer to the Dome of the Rock, the Gates of the Temple Mount, and the four minarets. Muslims consider the entire compound to be a holy site.

On Jerusalem, I recommended that the Arab neighborhoods be in Palestine and the Jewish neighborhoods in Israel, and that the Palestinians should have sovereignty over the Temple Mount/Haram and the Israelis sovereignty over the Western Wall...Obama needed to hear this from Clinton. 

Israel has a very different view of the situation.

Jerusalem is one whole city.  It is not to be divided.  Israel won the 1967 war when they were attacked by all Muslim nations and yet they won.  This remains one of the most dramatic statements in Israel's history. Since the reunification of Jerusalem in 1967, the city has become a haven for coexistence and revitalized religious and cultural expression for all faiths.  Jerusalem was reunified under Israeli rule as a result of the 1967 Six-Day War launched against Israel by the Arab world.
Despite Israel's appeal to Jordan to stay out of the war, Jordanian forces fired artillery barrages at Israeli cities and also attacked and occupied the UN headquarters in Jerusalem. At first Israel held back but eventually was forced to counterattack and within two days was able to defeat and repulse the Jordanian forces across the West Bank and retake Eastern Jerusalem. On June 7, IDF paratroopers, after fierce fighting with Jordanian soldiers, were able to advance into the Old City and gain control of the Temple Mount and the Western Wall.  "The Temple Mount is in our hands" – the report from Paratroop Commander Lt. Motta Gur – remains one of the most dramatic statements in Israel's history.
In July 1980, the Knesset passed the Jerusalem Law as part of the country's Basic Law, which declared Jerusalem the unified capital of Israel.

Clinton continued:  "When Arafat came to see me...he wanted Israel to have the Wailing Wall, because of its religious significance, but asserted that the remaining fifty feet of the Western Wall should go to the Palestinians. I told him he was wrong, that Israel should have the entire wall to protect itself from someone using one entrance of the tunnel that ran beneath the wall from damaging the remains of the temples beneath the Haram"

The Old City has four quarters: Jewish, Muslim Christian, and Armenian. It was assumed that Palestine would get the Muslim and Christian quarters, with Israel getting the other two.

Obama tried to portrait UNSC 2334 as being about settlements but it is actually much more than that. If Obama just wanted to stop settlement growth, as he claims, why did he authorize a resolution that rules that both Jerusalem's Temple Mount and the Western Wall are “occupied Palestinian territory”?

This book presents a point by point comparison on Territory, Securiy, Jerusalem, Holy Sites, Refugees.-Before UNSC 2334 the territories were "disputed", now they are "illegally occupied". 

Obama's UNSC 2334 turned Israel into a criminal State. Obama's UNSC 2334 has killed the Peace Process, there is nothing left to negotiate. 

The ICC will now impose a timeline for an Israeli withdrawal. The ICC will give Israel a choice: stay in the territories and be marginalized as a criminal State or withdraw from the territories and commit suicide. Obama's UNSC 2334 is a formula for Israel's destruction: If Israel withdraws from all the West Bank's land, Hamas will take over and attack Israel from the West Bank from as it does from Gaza.

Obama was not qualified to make such decisions.  He was not a general, but his original job before going into politics was that of a lawyer, but not international law.  After graduating, he became a civil rights attorney and an academic, teaching constitutional law at the University of Chicago Law School from 1992 to 2004. Turning to elective politics, he represented the 13th district in the Illinois Senate from 1997 until 2004, when he ran for the U.S. Senate.  He knew more than Trump about the constitution, but certainly not more than Kontorovitch on international law.  

When Netanyahu succeeded Olmert, he declared that "all of Jerusalem would always remain under Israeli sovereignty" and that only Israel would "ensure the freedom of religion and freedom of access for the three religions to the holy places".

These statements seem to closely reflect Israeli public opinion. According to a 2012 poll by the right-wing Jerusalem Center for Public Affairs, 78% of Jewish voters who responded said that they would reconsider voting for any politician that wants to relinquish Israel's control over the Old City and East Jerusalem.

On 17 May 2015, Prime Minister Netanyahu reiterated, regarding Jerusalem serving as the capital of both Israel and a future Palestinian state, "Jerusalem has forever been the capital of only the Jewish people and no other nation."

On 2 January 2018 Israel passed into law new legislation that requires the two-thirds majority support of the Knesset for any section of Jerusalem to be transferred to a foreign government.

On 25 January 2018, Netanyahu repeated the previous government position but seemed to alter it, reportedly saying: "Under any peace agreement the capital of Israel will continue to be in Jerusalem."

Obama's Feelings and Actions Towards Israel That Affect Biden

      The former Democratic leader, Barack Obama,  said that while 70 percent of American Jews gave him their vote, there were some concerns among members of the America Israel Public Affairs Committee (AIPAC) lobby, which feared that he did not feel his outward support for the Jewish state in his “guts”.  

It was showing more than in his guts.  They were just being nice.  It was in many of his programs concerning Israel. AIPAC stands for Americans and Israelis Public Affairs Committee, and members are active members of their Jewish community.

****Obama asserted Israel's move back to the 67 lines  of importance to him. It was impossible for Israel to do.  Netanyahu and Obama never did see eye to eye.  

****By abstaining — instead of vetoing the resolution, as the United States has reliably done to similar measures for decades — the Obama administration allowed the highly symbolic measure to make it through the chamber. President Barack Obama had decided to go out with a bang: In a stunning diplomatic rebuke of Israel, the United States on Friday abstained on a controversial United Nations Security Council resolution demanding an end to Israeli settlements on Palestinian territory, allowing it to pass easily.

Before his meteoric rise to the presidency, Obama had developed an intimacy with the Palestinian-American community, and an empathy with its narrative, that few politicians achieve. As an Illinois state senator with many Palestinian-American constituents, he often attended community events at which he “was forthright in his criticism of U.S. policy and his call for an evenhanded approach to the Palestinian-Israeli conflict,” according to Electronic Intifada ****founder Ali Abunimah’s firsthand account. (He had chosen the Palestinians to back before becoming President.)  

****On becoming president, he went to Egypt and made his Cairo Speech on June 4, 2009.  He insisted that the Muslim Brotherhood sit in the front row.  They had been jailed, breaking Egyptian laws.  Muslim Brotherhood was against Israel, of course.  

AIPAC, The American Israel Public Affairs Committee,  is a lobbying group found in 1963 that advocates pro-Israel policies to the legislative and executive branches of the United States. They are defenders of Israel.  They  have been in competition lately with the newer group, J Street, run by Jeremy Ben Ami,  Jeremy Ben-Ami: one of Washington's upcoming 500.

Liberal Jewish lobby group J Street has received sizable donations from multi-billionaire George Soros, the Washington 

Times reported Friday. The American financier has in the past criticized J Street's rival, AIPAC, for being too hawkish. 

 





 J Street, those  whose stated aim is to promote American leadership to end the Arab–Israeli and Israeli–Palestinian conflicts peacefully and diplomatically. J Street was incorporated on November 29, 2007. They spend most of their time criticizing Israel, though their propaganda says otherwise.  

Obama would go for this group. Ben-Ami was President Bill Clinton's Deputy Domestic Policy Adviser, and later Policy Director on Howard Dean's presidential campaign. They're hyper-critical of everything Israel does acting as if only they know better-directing while on their American couches..  Their expectations show me that they know nothing of Israel's or even our Jewish history, or even very little of our religion.  

So Israel has many forces that are trying to tear them apart.  Israelis are all brilliant, every man a king in his own home, and that's how we like it, but when it comes to politics, there are a lot of parties. Coming from so many locals, they are individuals in their thinking, not followers.   That's one sphere of problems.  Then there are the Palestinians who swore at the end of the 1967 Six Day War in Kartoum, Africa, at their big confab meeting, that they would never give into the Jews and accept them in their 3 famous No No Nos. 

         Youssef al-Qaradhawi, broadcasting hatred for Israel, based in Qatar but from Egypt. He has written about the dangers of Muslim extremism,  but on the other hand, Al-Qaradawi himself has advocated extremism and anti-semitism, denouncing Jews for their "corruption" and describing Adolf Hitler as having put Jews "in their place", and advocates killing Jews,  while others believe Al-Qaradawi is merely "not afraid to state firmly that 'Palestinian martyr operations are a weapon of the weak.'"  Qaradhawi is the darling of Qatar's Emir.

 They have been attacking Israelis in every way they can think of, using directly with rockets, mortars and missiles, but with forest fires and such, too, underground tunnels, etc.  Then we have the realistic enemies who haven't given up, Iran, who has sworn all along to wipe out Israel, and they do it by putting their soldiers closer to Israel in Israel's neighbor states.  Israel's surrounded by this Iranian=led warring band.  Iran, meanwhile, is creating a rocket to use from Iran that will fly to Israel holding a nuclear warhead.  You can count on Iran.  They are hateful; telling Israel how much they are hated all the time through several Ayatolahs.  Economically, there's been BDS trying to keep everyone from doing business with Israel, buying from Israel, etc.                                  

The 46th President of the United States has Irish roots that stem from two different families: the Blewitts of Co Mayo and the Finnegans from Co Louth. He's a real Irishman.  

Joe Biden, who just came down with a mild case of COVID 19 this morning at age 79,  was born in Pennsylvania on November 20, 1942 then went into Democrat politics by 1969 , then in politics in Delaware as Senator from 1973 to 2009, and from 2009 to 2017 was  Vice President under Obama, and was president by last year in 2021.

Biden’s Talks With Israeli Leader Highlight a Split Over Iran 

It looks as if Biden and Israel are not seeing eye to eye on Iran's nuclear developments.  After a meeting in Jerusalem, Israel’s caretaker prime minister, Yair Lapid, said nations must promise to act if the Iranians “continue to develop their nuclear program,” pushing for President Biden to go beyond his declared position.   

  • Iran Nuclear Deal: President Biden’s push for the 2015 deal’s revival during his visit to Israel underscored divisions among Israeli security officials over the issue as well as between the USA and Israel.

  • New York Times feels that Israel's security wants a deal. The problem with any deal is that the last deal turned out to be a stall and a lie.  Israel's security surely know that. 

    Israel cannot trust anything that Iran's Ayatollas say.  They aren't like the old regime, the king Mohammad Reza Shah , who got along with Israel.   

Journalist and TV anchor Wolf Blitzer has described Biden as loquacious. He often deviates from prepared remarks and sometimes "puts his foot in his mouth." The New York Times wrote that Biden's "weak filters make him capable of blurting out pretty much anything." In 2018, Biden called himself "a gaffe machine". Some of his gaffes have been characterized as racially insensitive.

  Where we all thought he was going to be president for one 

term, we see  he now wants another.  

  • Biden continues to call  for a ‘lasting negotiated peace’ between Israel and the Palestinians.

  • Biden was greatly impressed by Golda Meir, and her answer of "We have nowhere to go has remained with him," but seems to remain unaffected towards Israel continued problems with them.  Golda served as the fourth prime minister of Israel from 1969 to 1974. She was the first woman to become head of government in Israel.   Biden had In 1968,  earned a Juris Doctor degree from the university's College of Law, ranked him 76th in his class of 85 students. He was admitted to the Delaware bar in 1969 and practiced as a lawyer before running for political office.                   

Through it all, Israel is unperturbed.  They have continued to achieve their goals of mending the world,  doing good deeds to their fellow man,   turning their civilians into an army ready at the moment, defending their homes and country, and not forgetting their roots.  They're on a mission and will accomplish it. They have re-made their home to fit today's world, a protected reservation for the Jewish people who have been under anti-Semitism since their inception-attacked by the Amaleks-Amalek (/ˈæməlɛk/; Hebrew: עֲמָלֵק, 'Ămālēq, Arabic: عماليق 'Amālīq) was a nation described in the Hebrew Bible as a staunch enemy of the Israelites. The name "Amalek" can refer to the nation's founder, a grandson of Esau; his descendants, the Amalekites; or the territories of Amalek, which they inhabited, and the Greeks, Romans, etc.

USA Not Dodging the Bullet Since 9/11 While Dealing With Peace in the Middle East

"On September 11, 2001, 19 militants associated with the Islamic extremist group al Qaeda hijacked four airplanes and carried out suicide attacks against targets in the United States. Two of the planes were flown into the twin towers of the World Trade Center in New York City, a third plane hit the Pentagon just outside Washington, D.C., and the fourth plane crashed in a field in Shanksville, Pennsylvania. Almost 3,000 people were killed during the 9/11 terrorist attacks, which triggered major U.S. initiatives to combat terrorism and defined the presidency of George W. Bush.(January 2001-2009)"                                          

President George Walker Bush had just started trying to solve the Israel-Palestine peace process, taking office January 20, 2001,  which would bring about a state of Palestine, which was receiving a lot of his attention.  His Roadmap Towards Peace " contained the principles of the plan, originally drafted by U.S. Foreign Service Officer Donald Blome, (Donald Blome, a career Foreign Service officer, assumed the position of American Consul General in Jerusalem July 27, 2015. Prior to that, he worked as Director of the State Department’s Office of Arabian Peninsula Affairs from 2013-2015.)  were first outlined by U.S. President George W. Bush in a speech on 24 June 2002, in which he called for an independent Palestinian state living side by side with Israel in peace."  This call for a Palestinian State came after being hit on September 11, 2001.

After such an attack in New York by Saudi Arabian terrorists of al Qaeda, the Roadmap was almost like a mea culpa.  His father had put a lot of pressure on Israel, and now the Arabs felt they had to be heard since Clinton was looked upon as weaker with this tiny country, and so did Bush. They wanted Israel wiped out!

                                                           


  The Bill Clinton's 2000 Camp David Summit was a summit meeting at Camp David between United States president Bill Clinton, Israeli prime minister Ehud Barak and Palestinian Authority chairman Yasser Arafat. The summit took place between 11 and 25 July 2000 and was an effort to end the Israeli–Palestinian conflict. The summit ended without an agreement.  Arafat didn't get his way, but neither did Israel.  There were countries who took the USA's response to 9/11 as weak.                                           


His father, President George Herbert Walker Bush (1989-1993) was one to  get  tough with Israel.  President George H.W. Bush insisted on a delay in loan guarantees to Israel until after a multilateral peace summit in Madrid, Spain, in October 1991.  His son's attitude towards Israel may be affected by his father's  attitude.                                                 


Before Bush's term, Ronald Reagan was president from 1981 to 1989.  In his speech, Mr. Reagan said specifically that the United States would ''not support the establishment of an independent Palestinian state in the West Bank and Gaza.'' The President added that in the American view ''self-government by the Palestinians in the West Bank and Gaza in association with Jordan offered the best chance for a durable, just and lasting peace.''

 Being Israel was established for Jewish people, I will mention that Former Episcopalian, Bush left his family's Episcopal church to join his wife's United Methodist church, if this has anything to do with George Walker Bush's own ideas.  It does show that he wants to live in peace with his wife.  Do people see Judaism and Islam as similar as Methodists and Episcopalians?  

Jimmy Carter, our 39th President (1977-1981) , was all for a 2-state solution, but he wrote terrible things in his book/books about Israel.  

 President Ford, our 38th President (1974-1977), said,  that first they have to recognize Israel before any talks can be made." r 3, 1975)(November 3, 1975)

Beginning with the Nixon Administration starting in 1969-1974), presidents with their good intentions have unknowingly sponsored and participated in a plan by Israel's enemies to eliminate the nation of Israel by forcing her into indefensible borders.  When Obama asked to go back to before 1967, did he realize what he was saying? Look at the distances.  1967 was a war Israel had to fight defensively against Egypt, Syria, Jordan, and Iraq.  And why?  Because they are Jews, not Moslems.  

Israel insists on peace with secure borders.  Israel has only known armistice lines and cease fire lines.  She wants borders that are defensible, and not constitute a temptation to a potential aggressor as did the pre-1967 lines.  

                                                             


  Jordan was given 80% of the Jewish Homeland, promised to the Jews,first mentioned in the Balfour Declaration by the British who held the 30 year mandate.

Israel was created in the first place as a haven for the remaining Jews in the world.  The Holocaust wiped out 6 million after the planning of the state; with the war ending in 1945 and the state being created and accepted May 14, 1948.  Jews make up less than 1% of the world population, and only ask for a teeny part of the promised homeland made in 1920s by the League of Nations.  Is it so much to ask for their religious historic places to be a part of their homeland?  This cold-shoulder attitude, coming with some people's "Replacement Theory in their own religion, shows why they don't mind cutting the Jewish Homeland into pieces already and leaving very little for all the Jews of the world who have been returning to Israel after 2,000 years. They came here because it was here that they originally came from.  The land is part of their being, a direction from G-d to live in this place.  Are they the only ones left on earth that reads "The Old Testament?"  Of course not.  

"Since 9/11, our War on Terror,  our country has been faced with more than challenges;; catastrophes, political disruptions. 

We've had a trillion dollar hit on the U.S. economy due to 9/11/2001 terror events and the war on terror.  

,We had a $300 billion and growing war in Iraq and Afghanistan. with a decrease of soldiers just now happening.  "The War in Afghanistan stems from the United States invasion of Afghanistan on the 7 October 2001, when the United States of America and its allies successfully drove the Taliban from power in order to deny Al-Qaeda a safe base of operations in Afghanistan.  The War in Iraq started on March 20, 2003, all during George Bush's first term.  The Iraq War was a protracted armed conflict that began in 2003 with the invasion of Iraq by a United States-led coalition that overthrew the government of Saddam Hussein. The conflict continued for much of the next decade as an insurgency emerged to oppose the occupying forces and the post-invasion Iraqi government.  U.S. keeps 13,000 troops as October 2019 in Afghanistan.Result: Withdrawal completed in December 20, 2020...

National Terror Alerts have been costly and we've had many of them.

Concern of a Weapon of mass destruction attack on the USA-mainly from Iran, but North Korea is not out of the picture, either.

US government and embassies worldwide have had strained relationships over the war on terror; before Trump.

World leaders relationship with USA have been strained over Iraq and war on terror before Trump.

Bush's agenda included controlling 2 houses of Congress in his 2 terms, but Republicans were losing confidence and beginning to distant themselves from him for fear he could hurt them in their re-election efforts.  There's that putting re-election first and not the country again.  

People wanted to hear Bush talk about education, faith-based initiatives, anything but they heard more of Osama bin Laden, al Qaeda, Iraq and the War On Terror.

No one understood the size and complexity of the Middle East terror war.

Secretary of State Rice admitted there have been many errors in Iraq, and she was the one who walked out of Netanyahu's speech at the UN in preference for a luncheon date.  

Washington DC was becoming like a fortress; US cities were tightening their security, security cameras were placed throughout the country.  

The land of Israel was a mess ever since the Romans destroyed Jerusalem and their 2nd Temple in 70 CE.  It has been waiting for the Return of the Jews to blossom once again, and that is because it is so dear to the Jews.  No one else lived there as a nation.  It became a land of weeds and swamps and mosquitoes.  

The USA  has also had a surge of  extra problems since 9/11.

President Obama, our 44th president, took a very different stand from President Trump, who had his own peace plan.  Mr. Obama reaffirmed the crucial elements of the Camp David agreement from  and Resolution 242 by calling for a complete freeze on the building of settlements, constructed illegally (not according to Israel and International Law)  by Israel on Palestinian territory. (Israel Territory by conclusion of 1967 War where Israel fought a defensive war).  Later, in 2011, the president made clear that “the borders of Israel and Palestine should be based on the 1967 lines, (undefensive lines-not permanent lines).  ” 

Each presidency usually comes with its own set of problems; political and those out of our hands.    Now we're faced with COVID 19 Pandemic and its cost, of which I cannot fathom, causing more homeless people for those that live through it.  

 During this horrid period, Israel is getting peace with 2 Arab countries so far, which is a miracle in itself, initiated, I'm afraid, by the danger Israel and they face from Iran, a non-Arab country, though highly competitive.  

William Koenig has noticed and listed all the act of Mother Nature and other problems that presidents have to deal with that have happened after decisions against Israel have taken place.  We always have floods and such, but we never have considered them connected to what has happened to Israel, and he is astonishingly right.  Much has taken place.  He reminds us in his book that G-d will deal with the nations that come against Jerusalem "and all the nations of the world will gather against it," (Zachariah 12:3);  and ....for the Lord will have comforted His people.  He will have redeemed Jerusalem (Isaiah 52:7-9).  " And it shall come to pass in that day, that I will seek to destroy all the nations that come against Jerusalem."  (Zachariah 12:9)  After all, the word, the name "Israel" is biblical; it's not like New York City or Paris or Moscow.  Israel is ancient history and it is modern history-same place-in our working world.  Updated 12/6/2020.  

Perhaps this will be the impetus to bring peace between the Palestinians and Israel so that Israel can live in peace for the first time in its 72 years.
